Purpose

  • Sending commercial communications related to MPA products and services similar to those contracted. In this case, MPA's legitimate interest is based on keeping you informed and up to date about products or services that may be of interest to you.
  • Consulting public creditworthiness files to verify whether you are up to date with payments, whether you have any outstanding debts, and if you had any in the past, how long it took you to pay them, which will simplify and facilitate the risk analysis procedure when contracting. In this case, MPA's legitimate interest is based on preserving the security of its operations and preventing fraud.
  • Sending communications via instant messaging applications, such as WhatsApp Business, for the purpose of managing and claiming an outstanding debt with MPA.

3. Responsible Use of Artificial Intelligence in Security Services

At PROSEGUR, we use Artificial Intelligence (AI) technologies in some services to improve incident detection, alarm management, and customer service.

These tools are applied responsibly, in compliance with the GDPR, the LOPDGDD, and the European Artificial Intelligence Regulation (AI Act).

The AI used does not make automated decisions that have a significant impact on the user without human intervention.

We therefore recommend that you consult the privacy policy of your smart device. This information exchanged with your smart device will consist of:
    • A token or identification code for authenticating your MPA user account, so that you do not have to enter your username and password every time you want to use this feature.
    • The actions you request from your smart device to MPA (for example, activating the alarm, taking a photo, etc.).
    • The security events you request to be read by your smart device.

Likewise, MPA's service providers, with whom this entity has contracted the services of (i) professional advice, (ii) administrative management, (iii) system installation and maintenance, (iv) incident management, (v) hosting, (vi) logistics, (vii) marketing, (viii) digital services, (ix) commercialization, and (x) collection management.

Service providers may be located in countries with a level of data protection that is not comparable to that in Europe, although MPA will have the appropriate safeguards in place to carry out such international data transfers. 5. Data retention

The retention period for your data will be determined based on the duration of your relationship with MPA and the periods established by law. In this regard, the criteria used by MPA to set the retention periods for your data have been determined in accordance with the requirements established in the applicable legislation, regulations, and regulatory guidelines, as well as MPA's operational requirements related to the proper management of the relationship with Platform users.

In particular, your data will not be retained for more than six (6) years from the end of any possible contractual relationship between you and PROSEGUR, the above period having been set in accordance with Article 30 of the Commercial Code, with the exception of images and, where applicable, sounds, which are captured by systems that will be retained for a maximum period of thirty (30) days, as established in Article 22.3 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights.

Notwithstanding the foregoing, in the event that there is ongoing legal proceedings in relation to you, your data may be retained for the additional time necessary until a final court decision is obtained.

SMART Application Privacy Policy

In this regard, this privacy policy regulates the processing of data carried out by MPA in relation to customers and/or users interested in the Platform, who access or transmit information through it. The CUSTOMER's refusal to provide the mandatory data will make it impossible to provide the service or process the request made to MOVISTAR PROSEGUR ALARMAS.

You guarantee the accuracy of the personal data provided to MPA, and MOVISTAR PROSEGUR ALARMAS may periodically request that you review and update the personal data it holds about you.

Likewise, in the event that you, as an MPA customer and user of the MPA Application, and in order to enable the services offered by MPA, provide identification data of contact persons who may belong to your circle of trust, you guarantee that, before providing this third-party data, (i) you have previously informed the data subjects of the provisions contained in Article 13 of the GDPR, and (ii) you have obtained the unequivocal consent of the data subjects for the stated purpose, unless another basis for legitimacy applies, in accordance with the requirements contained in the GDPR.

This data will be processed for the purpose of managing your registration and use of the MPA Platform, allowing you to access its features, which include the following:

(i) Remote access to the security system installed via your mobile device, allowing you to take images from various detectors, access your cameras live, review recordings, connect or disconnect the security system from anywhere, and activate audio recording in your business when you leave your alarm connected. However, once this device is disconnected, audio recording will be automatically disabled.
Please note that in order to access these features, you must grant access permissions to videos, photos, multimedia files, and sounds on your device through the Application. If you deny these permissions, the Application will not be able to provide the service offered.

(ii) link smart devices (e.g., mobile phones, smart speakers, or Movistar's Smart WiFi Router, among others).

  • When using smart speakers, you will be asked to provide the country and postal code of the device. This information will be used by MPA to adapt security event information to the corresponding language and time zone. The information exchanged with smart devices will consist of:
    • A token or identification code for authenticating your MPA user account, so that you do not have to enter your username and password every time you want to use this feature.
    • The actions you request from MPA via your smart device (e.g., activate the alarm, take a photo, etc.).
    • The security events you request to be read by your smart device.
  • If you decide to link MPA services to your Movistar Smart WiFi Router and share third-party data for the use of this service, you guarantee that you have obtained their consent.
  • If you decide to view the images captured by the MPA security system on your television, through Telefónica's Movistar + application, your data will be transferred to Telefónica España S.A. for this purpose.

(iii) view contracts, services, and payment methods

(iv) view and download invoices.

(v) modify contact details for notifications in the event of alarm triggers.

(vi) receive alerts and notifications.

(vii) activate and use different features of the ContiGo service, such as the “Panic Button” and “Countdown,” which are described below:

  • Panic Button: in case of emergency, by pressing a button on the mobile app, the user will activate an emergency protocol that will allow the operator of the MPA Alarm Receiving Center (ARC) to (a) view the location of the user's mobile phone and (b) view a video and audio clip from the terminal's camera and microphone, provided that the user has granted the app the necessary permissions to access the device's GPS, camera, and microphone.
  • Cuenta Atrás: allows you to set a time period, after which, if not canceled by the user, an emergency protocol will be activated that will allow the MPA Alarm Receiving Center operator to view the location of the user's mobile phone, provided that the user has granted the application the corresponding access permissions to the device's GPS.

Users may at any time disable the ContiGo app's access permissions to the device's geolocation, camera, and microphone, although the app's features may be limited or impeded.
(viii) use the MPA Intelligent Recognition system if you have contracted it. This system consists of identifying events through automated video analysis with artificial intelligence, and receiving alerts and video clips in real time through the Application, contributing to improved comfort in the home. The system can perform:

  • Recognition of movement of people and pets: It can differentiate whether the event was caused by a person, animal, or object.
  • Sound recognition: It can recognize different sounds, such as a baby crying, a dog barking, glass breaking, an alarm, etc.

  • If you, as a customer, register on the online store platform, perform the administrative tasks arising from the management of your registration on said platform.
  • Manage the contractual relationship with you and ensure the provision of the services offered by the MPA Platform.
  • Manage remote access to your security system via your mobile device, allowing you to access its features, such as access to images from various detectors, live access to your cameras, reviewing recordings, connecting or disconnecting the security system from anywhere, as well as activating audio recording in your business when you leave your alarm connected, although once this device is disconnected, audio recording will be automatically disabled.
  • Manage the sending and receiving of service and security alerts and notifications (such as reminders to connect the alarm on high-risk dates, configuration recommendations, and app usage guides) related to the current status of the installed alarm.
  • Enable management of the smart device, Movistar Smart WiFi Router, as well as access to its features, such as sending notifications.
  • Enable access to the features included in the MPA Intelligent Recognition service, if contracted.
  • Use the Panic Button and Countdown features, provided that the user requests and grants the necessary access permissions.
  • Manage technical incidents with the App, as well as complaints and queries from its customers and users.

However, as a user, you can authorize or reject the use of this information at any time through the settings of your smart speaker application.
  • In the event that you decide to link MPA services to your Movistar Smart WiFi Router and share third-party data for the use of this service, you guarantee that you have obtained their consent.

  • Sending notifications through instant messaging applications, such as WhatsApp Business, for the purpose of managing and claiming an outstanding debt with MPA.
  • Carry out profiling based on your personal data or on anonymized or aggregated data to calculate the likelihood of purchasing other products or contracting other services that may beof interest to you,  as well as the propensity to cancel contracted services and the assignment of an evaluation. In this case, MPA’s legitimate interest is based on its interest in retaining its customers.
  • Undertake business process automation projects to improve the products and services offered by MPA. The legitimate interest in this case would be to enhance the efficiency and productivity of MPA’s operations.

3. Responsible Use of Artificial Intelligence in Security Services

MOVISTAR PROSEGUR ALARMAS (hereinafter, MPA) informs the CUSTOMER that some of the systems and services associated with the installation and management of alarms may incorporate components based on Artificial Intelligence (AI) technologies, intended exclusively to improve the efficiency of processes related to the installation, improvement, or maintenance of our security systems, early detection of incidents, and reduction of false alarms, as well as to optimize customer service. These systems operate in accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD), and Regulation (EU) 2024/1689 on Artificial Intelligence (AI Act), ensuring the safe, transparent, and non-discriminatory use of these technologies. MPA ensures that the security systems marketed by MPA that incorporate AI for their operation:

(i) Have been duly assessed in terms of risks and regulatory compliance in accordance with the AI Act.  

(ii) Maintain records and technical documentation required by applicable regulations.  

(iii) No automated decisions with legal or similar effects on the CUSTOMER are made without human intervention. The CUSTOMER is informed that the use of AI in these services does not imply autonomous or fully automated decision-making, and that they may request additional information on the general functioning of these systems, their purpose, and the guarantees applied in terms of data protection and transparency, through the channels indicated in this contract, for example by sending an email to: protecciondedatos@movistarproseguralarmas.com, and/or through the channels indicated in this privacy policy.

4. Origin of the data

The personal data that MPA processes in the course of its business are:

  1. Provided by the data subject at the time of contracting or through the app; and/or
  2. Collected automatically through the use of the Platform and/or devices connected to it; and/or
  3. MPA partner entities.

In this regard, we inform you that in order to access the remote access functionality of the security system through your mobile device, you are required to grant access permissions to videos, photos, and multimedia files on the device through the MPA application. If you deny these permissions, it will not be possible to provide the service offered by the application.

Thus, only the data strictly necessary for the fulfillment of the above purpose will be processed.
